A federal judge has ruled the prompt release of Kilmar Abrego Garcia from detention by ICE, concluding his ongoing confinement is without lawful basis.

"Since his return from erroneous imprisonment in El Salvador, he has been re-detained, again without legal justification," the judge wrote in her ruling.

The situation originates in a mistaken removal to El Salvador in March, which the government later admitted was an mistake. After his repatriation to the United States to answer alien smuggling charges, he was held in federal custody.

In her decision, the judge noted that the authorities lacks a valid deportation order, which prevents them from removing Mr. Abrego Garcia "at this time."

Context of the Case

The court challenge center on conflicting claims. Whereas the former administration argues that Abrego Garcia is a member of the MS-13 criminal organization, he categorically denies this allegation.

He has also entered a not guilty plea to the conspiracy counts, which are part of a ongoing trial in the state of Tennessee.

The judge, who was overseeing his petition to deportation in a Maryland district court, determined that he must now adhere to the conditions of his bond from custody in Tennessee. This order effectively transfers his supervision to the Tennessee court.
